1. Agreement to Terms

By accessing or using Nook ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 13 years of age (or 16 in the EEA).

2. Description of Service

Nook is a reading application designed to help users with ADHD and other reading challenges. Our Service includes:

  • Article and document importing and parsing
  • Customizable reading experience (fonts, colors, pacing)
  • Guided reading modes and focus features
  • AI-powered summaries and reading aids
  • Reading progress tracking and synchronization
  • Bookmarks, highlights, and notes

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to update this information to maintain its accuracy.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access or security breach.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms or harmful behavior.

4. Subscriptions and Payments

4.1 Subscription Plans

Nook offers both free and paid subscription plans. Paid plans provide access to additional features as described on our pricing page.

4.2 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually). Payment is processed securely through Stripe. You authorize us to charge your payment method for all fees incurred.

4.3 Free Trial

We offer a 7-day free trial with full access to all features. During the trial, you have unlimited access to articles, books, and PDFs. No credit card is required to start your trial. After the trial ends, you can upgrade to continue using Nook.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods.

4.5 Price Changes

We reserve the right to modify pricing. You will be notified at least 30 days before any price increase takes effect.

5. User Content

5.1 Your Content

You retain ownership of content you import into Nook. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.

5.2 Content Responsibility

You are solely responsible for the content you import. You represent that you have the right to use and import such content and that it does not violate any third-party rights.

5.3 Prohibited Content

You may not use the Service to store, share, or process content that is:

  • Illegal or promotes illegal activities
  • Infringing on intellectual property rights
  • Harmful, abusive, or threatening
  • Contains malware or harmful code

6. Intellectual Property

6.1 Our Property

The Service, including its design, features, code, and content (excluding user content), is owned by Nook and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our permission.

6.2 Feedback

If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation to you.

7. AI Features

Our Service includes AI-powered features such as summaries and reading aids. You understand that:

  • AI-generated content may not always be accurate or complete
  • You should not rely solely on AI summaries for critical decisions
  • Your content is processed by AI providers to deliver these features
  • We do not allow AI providers to use your content for training purposes

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or other systems
  • Interfere with or disrupt the Service or servers
  • Circumvent any access restrictions or security measures
  • Use automated tools to access the Service without permission
  • Impersonate others or misrepresent your affiliation
  • Violate the privacy rights of others
  • Use the Service in a way that could harm other users

9. Third-Party Services

The Service may integrate with or link to third-party services (e.g., Google Sign-In, payment processors). Your use of such services is governed by their respective terms and privacy policies. We are not responsible for third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any loss of data or content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOOK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Nook and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Nook.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any right does not waive that right.
  • Assignment: You may not assign these Terms. We may assign them freely.
